The Civil Law Court at the Temple of Justice in Monrovia has issued a Stay Order on the Liberia Telecommunications Authority (LTA) to halt all actions against LoneStar Cell/MTN until hearings into the case are heard and adjudicated.
The Stay Order, signed by Resident Circuit Court Judge, Yusif D. Kaba, directs the LTA to stay all further proceedings in connection with the suspension of the operation licenses of Lone Star Communications.
The issuance of the Stay Order by the Civil Law Court was prompted by a Motion to Compel Arbitration filed by the service provider LoneStar Cell/ MTN on Saturday.
The motion, in effect requests LTA, regulator of the telecommunications sector, to halt the suspension of LoneStar Cell/MTN and submit to the due process of law.
LTA admits that it has received the Stay Order and would abide by the mandate of the court. However, under the law, LTA has ten days to file its response before the court, and the judge will decide the date of the hearing.
LoneStar Cell/MTN Public Relations Director Lawrence K. Bropleh confirmed that the matter is now before the authority of the court.
He said the company sought the jurisdiction of the court to look into the merits and demerits of the case and determine its result.
Last week, LoneStarCell/MTN filed a notice of arbitration seeking to abort a recent decision by Liberia Telecommunication Authority (LTA) to suspend its operational licenses for three days beginning December 1, 2012.
LoneStarCell/MTN said the company's decision to file a notice of arbitration is not the interest of the country and its people.
He believes that any decision to suspend the operational licenses of LoneStarCell will have security implication.
Liberia Telecommunication Authority (LTA) last weekend announced that would suspend the operational licenses of LonestarCell/MTN for allegedly disconnecting Comium-Liberia.
The LTA explained that during the three days suspension period, LonestarCell/MTN subscribers will not make calls but will only receive calls from other networks.
