LiberCell Given Ultimatum

…To Settle Unpaid Taxes
The Judge of the Tax Court at the Temple of Justice in Monrovia has given the Management of Atlantic Wireless Incorporated or Libercell GSM a 15-day ultimatum to settle all unpaid taxes and licensed fees owed the government of Liberia.

Judge Eva Mappy Morgan instructed Libercell to pay US$734,963.00 as the total taxes and license fees owed the government within 15 days.

The Tax Court Judge's ruling in the case followed a Supreme Court mandate in a petition for a Writ of Certiorari” filed before Justice in Chambers, Cllr. Philip A. Z. Banks, III.

Justice Banks mandated the Tax Court Judge to resume jurisdiction over the case and ensure payment as stipulation of the parties which was endorsed by the court.

Judge Morgan also ordered the management of the GSM Company to pay additional clerk fees before December 21, 2012. The fees, she ruled, will be determined by the clerk and the lawyers.

The GSM Company was recently shut down by the Tax Court for the payment of over US$1,469,926.00 as tax obligations, as well as 6%t on balance judgment of US$88,195.58 it owed the Government of Liberia.

The Company initially failed to comply with the payment stipulations despite several warnings which led to its closure by the court.

Libercell committed itself to the payment of the amount by installments beginning April 2012 to January 2013 and vowed that the court set aside the stipulations and enforce the balance payments, if they failed to pay in full.

However, Wednesday's ruling indicates that the closure order remained enforced until full settlement of US$734,963.00 is made within 15 days.
